§ 2. GENERAL PROVISIONS
These Terms and Conditions set forth the terms and conditions for utilizing the Online Store, placing orders, concluding and terminating distance sales contracts, initiating complaint procedures, and exercising consumer rights.
Technical requirements for accessing the Online Store, reviewing the assortment, and completing orders include a terminal device with active Internet access, an updated web browser (with JavaScript and cookie support enabled), and an active electronic mail (email) address.
The Customer is strictly obligated to use the Online Store in accordance with applicable laws, standards of fair practice, and the provisions of these Terms and Conditions. The provision or transmission of unlawful content is strictly prohibited.
Product prices displayed in the Store are denominated in Euro (EU) and include all applicable taxes, including Value Added Tax (VAT gross prices). Advertised prices do not include shipping and delivery charges, which are calculated and disclosed to the Customer prior to definitive order placement.
§ 3. ELECTRONIC SERVICES IN THE STORE
The Seller provides the following electronic services through the Online Store infrastructure:
Interactive browsing of the product catalog and placement of purchase Orders via the digital Order Form,
Creation and administrative maintenance of an individual Customer Account (optional functionality),
Subscription and distribution of informative email communications (Newsletter).
The service enabling Order Form utilization is strictly single-use and terminates immediately upon final submission of the Order or voluntary cessation of the ordering process by the Customer prior to checkout completion.
§ 4. TERMS OF PLACING AND FULFILLING ORDERS
To complete an Order, the Customer selects the designated Product, adds the item to the digital shopping cart hosted on the Shopify platform, and proceeds to checkout, supplying mandatory delivery details, selecting the preferred shipping method, and indicating a payment option.
The effective placement of an Order requires the unreserved acceptance of these Terms and Conditions and the provision of truthful, complete, and verifiable contact and shipping credentials.
The Sales Contract is formally concluded upon the delivery of an explicit written confirmation of order acceptance issued by the Seller, transmitted to the Customer via automated electronic mail.
Specificity of the Motorcycle Industry (Part Selection): The Customer retains exclusive and sole responsibility for verifying and choosing appropriate spare parts, protective equipment, and accessories suited to their precise vehicle make, model, model year, and technical variant. In case of uncertainty regarding cross-compatibility, the Customer is advised to contact the Seller prior to purchase to confirm fitment against the vehicle’s VIN (Vehicle Identification Number).
Responsibility for Assembly of Accessories and Racks: The Customer bears full legal and operational responsibility for the proper assembly, fitment, and installation of motorcycle luggage (including top cases and side panniers) and corresponding structural mounting racks, adapter plates, or hardware in rigorous adherence to manufacturer specifications. The Seller excludes all liability for structural failures, vehicle detachment, personal harm, or property damage resulting from improper installation, amateur assembly, failure to adhere to torque ratings, or exceeding the maximum designated carrying payload.
§ 5. PRICES AND PAYMENT METHODS
The Customer may select from the following settlement methods during checkout:
Electronic payments and credit/debit card processing managed via certified payment processors integrated with Shopify,
Traditional bank wire transfer directly to the Seller’s designated business bank account,
Where traditional bank wire transfer is selected, the Customer is obligated to remit the full purchase price within 3 to 5 business days following order placement; failure to provide full remittance within this period constitutes grounds for unilateral order cancellation by the Seller.
§ 6. COSTS, METHODS AND DELIVERY TIME
Product fulfillment and delivery operations cover the geographical territory of the Republic of Poland and member states of the European Union.
Exact shipping costs (including carrier fees, expedited service charges, and automated parcel terminal tariffs) are explicitly calculated and displayed within the cart interface before order commitment.
Standard warehouse processing and packing intervals span from 2 to 3 Business Days from payment confirmation, unless alternative lead times are expressly stated in the item's individual product listing. Carrier transit durations (typically 1 to 2 Business Days domestically) apply additionally to warehouse handling times.
In the case of bulky, heavy, or oversized items (such as aluminum pannier sets or heavy engine guards), specialized shipping rates are presented prior to checkout. Upon physical delivery, the Customer is strongly urged to examine the parcel integrity in the presence of the courier; should mechanical destruction or package tampering be observed, the prompt creation of an official carrier Damage Protocol significantly expedites claim adjudications.
Export Outside the European Union: For deliveries outside the European Union, shipping terms, delivery times, customs duties, import taxes, and administrative procedures may differ. The Customer is solely responsible for paying any applicable customs duties, local import taxes, and clearance fees required by the destination country's customs authorities.
§ 7. RIGHT OF WITHDRAWAL (RETURNS)
A Consumer or an Entrepreneur with Consumer Rights who has entered into a distance sales contract retains the right to withdraw from the contract within 14 calendar days without assigning any reason and without incurring financial liabilities, excluding direct return logistics costs.
The statutory 14-day cancellation window commences on the date on which the Consumer, or a third party indicated by the Consumer (other than the freight carrier), acquires physical possession of the delivered Goods.
To exercise the right of withdrawal, the Customer must transmit an unequivocal notice of cancellation prior to the expiration of the withdrawal deadline (e.g., via electronic notification to info@plast-met.com).
Specificity of Motorcycle Accessories (Helmets, Apparel, Parts, Cases):
Returned merchandise must show no evidence of wear, use, or deterioration exceeding that which is strictly necessary to establish the nature, functional characteristics, and proper operation of the product. Helmets must retain intact factory visor protective films and hygienic seals, protective technical garments must have original swing tags intact, and mechanical components must show zero trace of bolt torque, tool engagement, grease, or installation.
The test-fitting of hard motorcycle cases and structural mounting frames must be executed with extreme precaution, strictly avoiding permanent clamp impressions, coating abrasions, scuffs on powder-coated or anodized surfaces, or screw head marring that impairs the re-marketability of the product as pristine, new stock.
Protective riding gear and helmets must be examined exclusively within clean, indoor residential environments.
Return Logistics Costs: The Consumer remains liable for discharging all direct shipping and transport costs associated with dispatching the Product back to the Seller's premises.
The Seller shall execute reimbursement of payments received within 14 calendar days of receiving the declaration of withdrawal. The Seller expressly reserves the right to withhold financial reimbursement until the Goods are physically recovered, or until the Customer submits verifiable proof of return transit dispatch, whichever occurs first.
§ 8. LIABILITY FOR CONFORMITY OF GOODS WITH THE CONTRACT (COMPLAINTS)
The Seller is under a statutory obligation to furnish the Customer with Goods that fully conform to the agreed Sales Contract.
Applicable statutory legal frameworks (notably the Polish Act on Consumer Rights) define and govern the Seller's legal liability regarding discrepancies or non-conformity of delivered Goods with the underlying contract.
Complaints Regarding Motorcycle Parts: In light of the technical risks inherent to motorcycle mechanics and electronics, warranty and non-conformity claims filed regarding structural, mechanical, or electronic motorcycle parts may require the claimant to provide documentary evidence verifying professional installation by a certified motorcycle workshop or automotive repair facility, to eliminate failure rooted in incorrect assembly, improper tools, or unauthorized modifications.
Formal claims and warranty notices can be submitted via:
Electronic mail to: info@plast-met.com,
Written post or freight dispatch addressed to the Seller's registered company address, accompanied by the contested item, valid proof of purchase (such as an invoice or order number), and a descriptive defect report detailing the operational failure.
The Seller shall examine and provide a definitive formal response to the Consumer's complaint within 14 calendar days from the date of official receipt.
§ 9. OUT-OF-COURT DISPUTE RESOLUTION
Comprehensive operational information detailing out-of-court redress procedures and alternative consumer dispute resolution systems is accessible on the official portal of the Polish Office of Competition and Consumer Protection (UOKiK) at www.uokik.gov.pl and through the competent Voivodeship Trade Inspection Inspectorates.
Consumers residing in European Union member jurisdictions are further entitled to engage the cross-border European Online Dispute Resolution (ODR) portal, accessible at: http://ec.europa.eu/consumers/odr.
§ 10. PERSONAL DATA PROTECTION (GDPR)
The administrative controller of personal data gathered in connection with the operations of the Online Store is the Seller (PLAST-MET Automotive Systems Spolka z o.o.).
Customer personal details undergo processing exclusively for the performance and execution of Sales Contracts, customer profile and account management, fulfillment of legal bookkeeping duties, and—subject to explicit separate approval—direct commercial marketing activities.
Comprehensive technical descriptions regarding privacy protocols, retention policies, data subject rights, and cookie mechanisms are contained within the Privacy Policy published permanently on the Shopify e-commerce platform.
§ 11. FINAL PROVISIONS
Sales Contracts concluded via the digital platform are formally drafted and executed in either the Polish or English language, according to the Customer's regional interface selection.
The Seller maintains the right to introduce amendments to these Terms and Conditions in response to verifiable legal, operational, or statutory triggers. Contracts entered into before the effective deployment of revisions remain governed exclusively by the terms effective at the specific time of Order confirmation.
In all matters omitted from regulation within these Terms and Conditions, the prevailing binding legislation of the Republic of Poland shall apply, including the Polish Civil Code, the Act on Consumer Rights, and the Act on the Provision of Electronic Services.
